Australian court returns lesbian group case to tribunal

Australia's federal court has sent back a ruling against the Lesbian Action Group. The group wants to exclude transgender women from its meetings. The tribunal previously decided this was not permitted. Now the case must be reassessed.

This touches a sensitive issue within the LGBTQ+ community. The Lesbian Action Group argues meetings are for biological women only. Transgender women should not be welcome at such events, they claim. The tribunal disagreed and ruled against the group.

The federal court has now determined the tribunal must reconsider the case. The court has not yet fully clarified which legal grounds applied. The matter returns to the tribunal for reconsideration.

Such cases raise sensitive questions about inclusion and equal rights. Groups have the right to decide their own membership on one hand. Anti-discrimination laws also apply to LGBTQ+ organisations themselves. It remains unclear how the tribunal will now rule.
